    Trump suggested that Smith’s filing, which has now been made public, disrupted the election since his new evidence was made public just 33 days before Election Day.

    Smith’s filing argues that Trump’s conduct around Jan. 6 were actions as a private individual and not official actions of a president.

    “Donald Trump launched a ‘private criminal effort’ to undermine the 2020 US election and should not be protected by presidential immunity,” he wrote.

    Trump, however, insisted Smith went too far.

    The new filing reveals tense private conversations between Trump and his Vice President, Mike Pence, over his decision to certify the election, contesting with Trump and his allies that he had the legal power to stop it. It also details the actions the president took to cast doubt on voting numbers in key swing states.

    President Trump argued on social media that the new filing was just one of the ways the Biden administration tried to disrupt the election.
