Donald Trump denounced special counsel Jack Smith after new evidence about the January 6 riots on Capitol Hill was made public just weeks before the election.
The former president accused Biden’s Justice Department of “election interference” following the release of 165 pages of evidence in his case — showing the president had private conversations with his employees, lawyers and allies leading up to and during the riot.
Judge Tanya Chutkan of Washington, DC, made the file public on Wednesday, despite the arguments of Trump’s lawyers.
Trump suggested that Smith’s filing, which has now been made public, disrupted the election since his new evidence was made public just 33 days before Election Day.
“WITH 60 DAYS BEFORE AN ELECTION, THE DEPARTMENT OF JUSTICE SHOULD DO ABSOLUTELY NOTHING THAT WOULD PROTECT OR DISRUP ANY CASE,” Trump wrote in all caps on his social media platform Truth Social.

Smith’s filing argues that Trump’s conduct around Jan. 6 were actions as a private individual and not official actions of a president.
“Donald Trump launched a ‘private criminal effort’ to undermine the 2020 US election and should not be protected by presidential immunity,” he wrote.

Trump, however, insisted Smith went too far.

The new filing reveals tense private conversations between Trump and his Vice President, Mike Pence, over his decision to certify the election, contesting with Trump and his allies that he had the legal power to stop it. It also details the actions the president took to cast doubt on voting numbers in key swing states.
President Trump argued on social media that the new filing was just one of the ways the Biden administration tried to disrupt the election.
